Brockton Probate Court Location

Brockton has a satellite session of the Plymouth County Probate and Family Court. It sits at 215 Main Street, Suite 220. This is not the main filing office. All new petitions and papers must go to the Plymouth main office at 52 Obery Street in Plymouth. The Brockton session handles hearings and gives access to court files. Free parking is a big plus at this location. There is a lot behind the courthouse that costs nothing. Metered street spots and a public garage across the street give more options. BAT Bus Route 8 stops near the building for those who use public transit. The MBTA commuter rail on the Kingston/Plymouth or Middleborough/Lakeville lines also reaches Brockton Station, which is about half a mile from the courthouse. Bring a valid photo ID when you visit because security checks all visitors at the entrance.

The Plymouth main office at 52 Obery Street in Plymouth is where all papers must be filed. You can also file by mail to P.O. Box 3640, Plymouth, MA 02361. Register Matthew J. McDonough runs the office and manages all case files for the county.

Probate Filing in Brockton

Brockton residents file probate cases under the Massachusetts Uniform Probate Code, found in M.G.L. c. 190B. This law sets the rules for wills, estates, trusts, guardianships, and conservatorships across the state. Even though Brockton has a local court session, all new filings must go to Plymouth. The Brockton location does not accept new petitions at its counter.

Informal probate is the most common type. Under Section 3-102 of the MUPC, the Register reviews the petition without a court hearing. You file a Petition for Informal Probate (MPC 150) at the Plymouth office. The filing fee is $375 plus a $15 surcharge, totaling $390. If you need formal probate with a judge, the base fee is the same but adds a $15 citation fee. Guardianship of a minor has no filing fee. Guardianship of an incapacitated person costs $255. Conservatorship filings also run $255.

You can submit papers through the eFileMA system instead of going to Plymouth in person. This platform accepts petitions for informal probate, formal probate, guardianship, and several other case types. There is a one-time $22 provider fee for each new case filed electronically. Credit card payments add a 2.89% processing charge. ACH payments cost just $0.25 per transaction.

All papers for Plymouth County must be filed at the Plymouth office (52 Obery Street) or through eFileMA. The Brockton session does not accept new filings.

Brockton Probate Record Copies
