Lynn Probate Court Locations

Lynn does not have its own probate courthouse. Residents file at the Essex County Probate and Family Court in Salem. The main office is at 36 Federal Street. There is also a satellite in Lawrence at 2 Appleton Street in the Fenton Judicial Center. Both locations accept filings and handle hearings. Salem tends to be the closer choice for Lynn residents.

The MBTA Newburyport/Rockport commuter rail line runs from Lynn to Salem Station, making the trip fairly easy by public transit. The ride takes about 15 minutes. Courthouse parking is available in Salem. The Lawrence location has two paid lots, a paid garage, and metered street parking. Probate Filing Process for Lynn

Lynn residents file probate cases under M.G.L. c. 190B, the Massachusetts Uniform Probate Code. This law covers wills, estates, trusts, guardianships, and conservatorships. You file at the Essex County court in Salem or Lawrence. The process is the same regardless of which office you use.

Informal probate under Section 3-102 is the most common path. The Register reviews your petition without a hearing. You file form MPC 150 and pay $375 plus a $15 surcharge. Formal probate costs the same base fee but adds $15 for a citation because a judge holds a hearing. Guardianship of a minor is free to file. Guardianship of an incapacitated person costs $240 plus $15. Conservatorship filings are the same at $255 total. The full fee schedule is at mass.gov.

Electronic filing through eFileMA lets you submit petitions from home. The system charges a $22 provider fee for each new case. After that first filing, additional submissions in the same case cost nothing extra from Tyler Technologies. Credit cards add 2.89% processing. ACH bank transfers cost just $0.25.

Getting Copies of Lynn Probate Records

Use the PFC 18 form to request certified copies of any probate court record. Fill in the court division (Essex), docket number, case name, and what documents you need. Mail the form with payment to the Salem office. Make checks payable to the Commonwealth of Massachusetts. The court only accepts attorney's checks, money orders, or bank certified checks by mail.

Copy fees are set by the state. Plain copies cost $1.00 per page. Attested copies are $2.50 per page. Certified guardianship decrees cost $22.00. Conservatorship decrees run $21.00 each. In person, most courthouses take cash and credit cards in addition to checks. The copy request instructions on mass.gov spell out each step and payment method.

Essex County has some of the oldest probate records in the nation. Files go back to 1638. Historical records through 1881 are available online through AmericanAncestors and FamilySearch. The published "Probate Records of Essex County, MA" by George Francis Dow covers three volumes from 1916 to 1920. Under M.G.L. c. 215, Section 1, the Probate Court has exclusive jurisdiction over these matters, so all records sit in one court system.
