Probate Filing Process in Lawrence

Filing a probate case in Lawrence follows the same state rules as every other court in Massachusetts. The process is governed by M.G.L. Chapter 190B, the Massachusetts Uniform Probate Code. You start by choosing the right petition type. An informal probate under section 3-102 is the simplest route when no one contests the will. The registrar reviews and approves it without a hearing. A formal probate under section 3-301 requires a court hearing and costs more due to the citation fee.

The filing fee for informal probate is $375 plus a $15 surcharge, which comes to $390 total. Formal probate costs the same $375 base fee plus a $15 citation fee and $15 surcharge for $405 total. Voluntary administration for small estates is $115. Guardianship of a minor has no filing fee at all. Guardianship for an incapacitated person costs $255. All fees are set statewide by the Massachusetts Trial Court and are the same at the Lawrence location as they are at Salem or any other court. The full fee schedule is posted at mass.gov.

Low-income filers can ask for a fee waiver. You file an Affidavit of Indigency with your petition. The judge reviews it and decides if you qualify based on your income and expenses.
